TERMS AND CONDITIONS COMPRY RECOVERY – HERZOG MEDICAL B.V.

1 General
1.1 Compry Recovery is part of Herzog Medical B.V. Therefor the terms and conditions will fall under Herzog Medical B.V.
1.2 The terms and conditions apply to all agreements relating to online orders between Herzog Medical B.V. and the customer.
1.3 The website of Compry Recovery and Herzog Medical B.V. are regularly supplemented and/or adapted. Herzog Medical reserves the right to make any changes with immediate effect and without any notice.
1.4 By placing an order, each customer agrees, without reservation, with the general delivery conditions.

3 Offers and offers 
3.1 The prices listed in the articles are in euros, including VAT. Shipping costs are not included in the prices listed.
3.2 Rental prices are listed in euros, excluding VAT. Shipping costs are not included in the rental prices listed.
3.3 The offer contains a complete and precise description of the products offered. The description is sufficiently detailed to allow a proper assessment of the offer. If the entrepreneur uses images these are as much as possible a truthful representation of the offered products.
3.4 Herzog Medical B.V. is not liable for the consequences of zet- typing and/or programming or program errors on it’s website. No rights can be derived from unlawful price information.
3.5 The limited validity and conditions of special offers, different from the usual range, are explicitly stated.
3.6 Offers from Herzog Medical B.V. do not automatically apply to reorders.
3.7 Herzog Medical B.V. cannot be held to it’s offer if the customer had understood that the offer contained an apparent error or a misrehension.
3.8 Additions, amendments and/or oral commitments shall be in force only if agreed in writing.

4 The agreement 
4.1 An agreement between Herzog Medical B.V. and the customer is reached after an order has been assessed for feasibility by Herzog Medical B.V.
4.2. If the customer has accepted the offer by electronic means, Herzog Medical B.V. immediately confirms the receipt of the acceptance of the offer by electronic means. As long as the receipt of this acceptance has not been confirmed by Herzog Medical B.V., the consumer may terminate the contract.
4.3 Herzog Medical B.V. takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment.
4.4 Herzog Medical B.V. can inform itself – within legal frameworks – whether the customer can meet his payment obligations, as well as all those facts and factors that are important for a responsible contracting. If, on the basis of this investigation, Herzog Medical B.V. has good grounds not to enter into the agreement, he is entitled to refuse an order or application or to attach special conditions to the execution.
4.5. Herzog Medical B.V. will send the following information to the consumer, in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable data carrier:
(a) address and contact details where the customer can contact with complaints.
(b) the conditions under which and the way in which the customer may benefit from the right of withdrawal, or a clear notification concerning the exclusion of the right of withdrawal.
(c) the information on guarantee.

5 Payment
5.1 Payment takes place through the payment methods offered on the website.
5.2 Payment of the order is always made in advance. The order will not be sent until the payment has been paid in full.

6 Shipping costs
6.1 The shipping costs depend on the destination of the order and are clearly displayed on the webshop.

7 Delivery
7.1 Herzog Medical B.V. outsources the home delivery of the orders to licensed postal companies and ensures that the customer can follow the status of the package.
7.2 Herzog Medical B.V. strives to send orders within 1 working day of receipt of the payment.
7.3 Herzog Medical B.V. has a judicial delivery period of 30 days. If the customer has not received the order within this period, he can cancel the purchase free of charge.
7.4 Herzog Medical B.V. strives to deliver all products from stock. However, an item may be temporarily out of stock or sold out. In this case, the customer will be informed, with the right to cancel the order free of charge. In this case, Herzog Medical will take care of the reimbursement.
7.5 Herzog Medical B.V. is not liable for any damage that the customer may suffer because the order was delivered to a residential address that was incorrectly specified by the customer.
7.6 The risk of damage and/or disappearance of products rests with Herzog Medical B.V. until the time of delivery to the consumer or a pre-appointed representative and disclosed to the entrepreneur, unless expressly otherwise agreed.

8 Cancel/change order
8.1 It is possible to cancel an order if this happened before 1pm on the day the order was placed and provided that the order has not yet been sent. You can report this cancellation by email or by phone.
8.2 It is possible to change the order or add any additional products to the order, if this happened before 1pm on the day the order was placed and provided that the order has not yet been sent. You can report this addidtion by email or by phone.

11 Guarantee and complaints procedure

11.1 Herzog Medical BV guarantees that the products delivered through its webshop meet the requirements of usability, reliability and lifespan as reasonably intended by the parties to the purchase agreement, and thus guarantees the warranty of the product delivered to you.
11.2 The customer is obliged to check the delivered items immediately upon receipt. If it turns out that the delivered order is wrong, or incomplete, the customer (before returning to Herzog Medical B.V.) must immediately report these defects in writing to Herzog Medical B.V. by sending an email to info@herzogmedical.com. Any mishandled items must be reported in writing within 1 week of delivery to Herzog Medical B.V. The return of the products must be returned in the original packaging (including accompanying documentation) and in new condition. Returns have to be announced before being send back through sending an email to info@herzogmedical.com with the reason of return (See 11.5). 
11.3 After finding that there is a default, damage caused by finding of default and/or resale following the finding of a default, this right to advertising and return shall cease to be practized altogether.
11.4 As proof of the guarantee, the customer of Herzog Medical B.V. receives a proof of purchase.
11.5 Herzog Medical B.V. has a sufficiently publicised complaints procedure and handles the complaint in accordance with this complaints procedure. Namely:
a) It is important that in the event of a defect or warranty on an article (webshop) purchased from Herzog Medical BV, the customer contacts the company by sending an email to info@herzogmedical.com
(b) This e-mail shall include the order number, a detailed description of the defect and, where appropriate, one or more photos of the defect.
(c) Upon receipt of the e-mail, the application shall be processed and returned within 14 days.
11.9 Where the customer’s complaint is effectively subject to the responsibility of Herzog Medical B.V., the amount of compensation will at all times be limited to a maximum of the invoice amount of the products in question.
11.10 In the event of replacement, the article returned by the customer automatically becomes the property of Herzog Medical BV
11.11 The said warranty does not apply if the defect has arisen as a result of:
(a) careless, improper or improper use
(b) where the items delivered have been treated on the packaging in contra regard to the instructions of Herzog Medical B.V. and/or instructions for use on the packaging
(c) where the washing requirements have not been followed
(d) where the buyer has attempted to apply amendments to the Article/has been edited by third parties
e) when the goods delivered have been exposed to abnormal conditions or otherwise carelessly handled.
11.12 When the product has been purchased through one of the points of sale of Herzog Medical BV, all warranty and complaints must go through the relevant point of sale.

12 Privacy
Your personal data will be included in the customer base of Herzog Medical B.V. We use your personal data to execute the agreement, conduct responsible customer management, risk management and for marketing purposes. We do not provide data to third parties that affect your privacy. If you no longer wish to receive any more commercial offers from us, you can confirm this to us by e-mail.
